Coachinho provides a subscription service that allows its members to stream online video courses ("Coachinho Content") over the Internet via Internet-enabled televisions, computers and other devices ("Coachinho Compatible Devices").
These Terms of Use govern your use of our Service. The terms "Coachinho Service", "our Service" or "the Service" as used in these Terms of Use refer to the personalised services offered by Coachinho for discovering and viewing Coachinho Content, including all features and functionality, recommendations and reviews, the user interface, and all content and software associated with our Service.
1. Membership
1.1 Your Coachinho membership will automatically run until you cancel it. In order to use the Coachinho Service, you will need internet access and a Coachinho compatible device and you will need to specify one or more payment methods. "Payment Method" means a current, valid and accepted payment method which you may update from time to time and which may include payment through your account with a third party. Unless you cancel your Membership prior to your billing date, you agree that the Membership Fee for each subsequent billing period will be deducted from your Payment Method (see the "Cancellation" section under our "Payment Terms").
1.2 In the current version, we offer two different membership subscriptions or subscription plans, the monthly subscription and the annual subscription. These differ in the billing period as well as in the costs (see "Terms of Payment").
2. Promotional offers
From time to time, we may offer special promotional offers, plans or memberships ("Offers"). Eligibility for an offer will be determined by Coachinho in its sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are not eligible. Members from households with an existing or recently terminated Coachinho membership may be excluded from certain offers. In order to check your eligibility status for an offer, Coachinho is authorised to access information such as the device ID, payment method or email address already used for an existing or until recently existing Coachinho membership.
Eligibility requirements and other restrictions and conditions will be disclosed when you sign up for the Offer or in other communications provided to you.
3 Coachinho Service
3.1 The Coachinho Service and any content viewed through the service is for your personal and non-commercial use only and may not be shared with anyone not living in the same household. During your Coachinho Membership, we grant you a limited, non-exclusive and non-transferable right to access the Coachinho Service and view Coachinho Content. Other than that, no right, title or interest is transferred to you. You agree not to use the Service for public screenings.
3.2 You may view Coachinho Content primarily in the country where you created your account and only in geographic regions where we offer our Service and have licensed the applicable Content. The Content available for viewing may vary by region and will also change from time to time.
3.3 The Coachinho Service, including the Content Library, is updated regularly. We also continually test various aspects of our Service, including our website, user interfaces, advertising features and the availability of Coachinho Content.
3.4 Some Coachinho Content is only available for a one-time purchase, which gives you a lifetime streaming right for that course.
3.5 You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale or use (except as expressly permitted in these Terms of Use) any Content or information available on Coachinho or obtained by you from or through the Coachinho Service. You also agree not to circumvent, remove, alter, disable, degrade or prevent any copy protection on the Coachinho Service; use any robot, spider, web-scraping or other automated process to access the Coachinho Service; not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Coachinho Service; not to insert any code or other products or otherwise tamper with the Coachinho Service; and not to use any data mining, collection or other extraction methods. You also agree not to upload, post, email or otherwise transmit any content that is intended to interfere with, disable or limit the functionality of any computer software/hardware or telecommunications equipment associated with the Coachinho Service. This also applies to any software viruses or other code, files or programs. If you breach these Terms of Use or use the Service in an illegal or fraudulent manner, we have the authority to terminate or restrict your use of our Service.
3.6 The display quality of Coachinho content may vary depending on your device and is dependent on various factors such as your location, the available bandwidth and/or the speed of your internet connection. The availability of HD, Ultra HD and HDR picture quality depends on your internet service and device. Not all content is available in all formats such as HD, Ultra HD and HDR. The default playback settings over mobile networks exclude content in HD, Ultra-HD and HDR. The minimum speed for watching movies and series in standard resolution is 1.0 Mbps. However, a faster connection is recommended for better picture quality. For receiving HD content (by definition a resolution of at least 720p), a download speed of at least 3.0 Mbit/s is recommended. For the reception of Ultra HD content (defined as a resolution of at least 4K), a download speed of at least 15.0 Mbit/s is recommended. You are responsible for all charges related to Internet access. Please contact your internet service provider for more information on any data usage charges. The time taken to start playing Coachinho content depends on various factors such as your location, the available bandwidth at the time of playback, the content selected and the configurations of your Coachinho compatible device.
3.7 The Coachinho Software may only be used for the purposes of lawfully streaming and viewing Coachinho Content using Coachinho compatible devices. This software may vary depending on the device and media and may have different functions and features. You acknowledge that use of the Coachinho Service may require third party software, for which third party licenses are required. You agree to receive automatically updated versions of Coachinho and related third party software.
4. Passwords and account access
The member who created the Coachinho Account and whose payment method is charged with the Membership Fees (the "Account Holder") is responsible for any and all activities associated with the Coachinho Account. In order to maintain control of the Account and prevent access by unauthorised persons (including the title history for the relevant Account), the Account Holder should always be in control of the Coachinho compatible devices used to access the Service and should not disclose the password or account details for the selected payment method to any third party. You are responsible for updating the information provided in connection with your account and for ensuring that it is kept up to date at all times. To protect you, Coachinho or our affiliates from identity theft or other fraudulent activity, Coachinho has the authority to terminate your membership or temporarily suspend your account.
5. Miscellaneous
5.1 Governing Law: These Terms of Service are governed by applicable German law. These Terms do not limit any consumer protection rights you may have under the mandatory laws of your country of residence. Coachinho does not participate in alternative dispute resolution procedures before a consumer arbitration board and is not legally obliged to do so.
5.2 Unsolicited Materials: Coachinho does not accept unsolicited materials or ideas for Coachinho Content and accepts no responsibility for any similarities that may exist between content or programmes in media and materials or ideas submitted to Coachinho.

5.4 If any provision of these Terms of Service is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected.
5.5 Electronic Communications: You will receive account-related information (e.g. payment authorisations, invoices, changes of password or payment method, confirmation and other notifications) exclusively in electronic form, for example as e-mails to the e-mail address you provided during your registration.
